This Privacy Policy explains how Logispro s.r.o. collects, uses, and protects your personal data in accordance with the General Data Protection Regulation (GDPR).

I. General Provisions

  1. The controller of personal data under Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR") is Logispro s.r.o., ID No. 06339271, with its registered office at Klírova 1912/12, 14800 Prague (hereinafter: the "Controller").

  3. "Personal data" means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

II. Sources and Categories of Personal Data Processed

  1. The Controller processes personal data that you have provided or personal data obtained by the Controller in connection with the fulfillment of your order.
  2. The Controller processes your identification and contact details and data necessary for the performance of the contract.

III. Legal Basis and Purpose of Processing

The legal basis for processing personal data is:

  • Performance of the contract between you and the Controller pursuant to Article 6(1)(b) GDPR;
  • The Controller's legitimate interest in direct marketing (particularly for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR;
  • Your consent to processing for direct marketing purposes (particularly for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, where no order for goods or services has been placed.

The purpose of processing personal data is:

  • Processing your order and exercising the rights and obligations arising from the contractual relationship between you and the Controller. When placing an order, personal data necessary for the successful processing of the order are required (name and address, contact). Providing personal data is a necessary requirement for entering into and performing the contract; without providing personal data, the contract cannot be concluded or performed by the Controller.
  • Sending commercial communications and other marketing activities.

Automated decision-making: The Controller does not engage in automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to any such processing.

IV. Data Retention Period

  1. The Controller retains personal data:
    • For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to enforce claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship);
    • Until consent to processing for marketing purposes is withdrawn, for a maximum of 10 years, where personal data are processed on the basis of consent.
  2. After the retention period has expired, the Controller will delete the personal data.

V. Recipients of Personal Data (Subcontractors)

  1. Recipients of personal data are persons:
    • Involved in the delivery of goods / services / processing of payments on the basis of the contract;
    • Involved in ensuring the operation of services;
    • Providing marketing services.
  2. The Controller intends to transfer personal data to a third country (a country outside the EU) or to an international organization. Recipients of personal data in third countries are providers of mailing services and cloud services.

VI. Your Rights

Under the conditions set out in the GDPR, you have:

  • The right of access to your personal data under Article 15 GDPR;
  • The right to rectification of personal data under Article 16 GDPR, or to restriction of processing under Article 18 GDPR;
  • The right to erasure of personal data under Article 17 GDPR;
  • The right to object to processing under Article 21 GDPR;
  • The right to data portability under Article 20 GDPR;
  • The right to withdraw consent to processing in writing or electronically at the address or email of the Controller set out in Article I of this Policy.

You also have the right to lodge a complaint with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů) if you believe that your right to the protection of personal data has been violated.

VII. Data Security Measures

  1. The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
  2. The Controller has implemented technical measures to secure data storage and the storage of personal data in paper form, in particular the use of antivirus protection, secure access passwords, data encryption, and secure storage of data and backups.
  3. The Controller declares that only authorized persons have access to the personal data.

VIII. Final Provisions

  1. By submitting an order via the online order form, you confirm that you are familiar with the Privacy Policy and that you accept it in its entirety.
  2. You agree to these terms by ticking the consent box on the online form. By ticking the consent box, you confirm that you are familiar with the Privacy Policy and that you accept it in its entirety.
  3. The Controller is entitled to amend these terms. A new version of the Privacy Policy will be published on the Controller's website, or a new version of these terms will be sent to the email address you have provided.

These terms take effect on 1 January 2023.
